Price Guarantee Challenge Terms and Conditions

Thank you for your interest in our Price Guarantee Challenge (the “Challenge”). These Terms and Conditions (“Terms”) govern your participation in the Challenge. By participating in the Challenge, you agree to be bound by these Terms.

Overview. If the Confluent Product Offering cannot meet or beat the Competitor Total Cost on an Eligible Product, we will offer you a USD $500 gift card or donation to a designated charity, subject to the eligibility criteria, exclusions, and participation requirements outlined below.

Definitions.

“Competitor Total Cost” means the total monthly fees and associated costs payable in connection with use of an Eligible Product.

“Confluent Product Offering” means the Confluent Cloud and/or Warpstream solution recommended by Confluent, minus the exclusions outlined below.

“Eligible Product(s)” means Apache Kafka managed services and Apache Kafka derivative managed services.

Eligibility Criteria. To qualify for the Challenge, the following conditions must be met:

• The Eligible Product must offer substantially similar features, functionality, and service levels
• You must be a new enterprise customer.

Exclusions. The following are excluded from the Challenge: 

• Current Confluent customers (who are always welcome to reach out to their customer service representative with any questions).
• Public sector entities.
• Employees, officers, directors, and agents of ours and our affiliates, and their immediate family members.
• Add-on services offered within Confluent Cloud, such as Connectors, Stream Governance, Stream Processing, and TableFlow. 
• Competitor services other than the Eligible Products.

Participation Requirements. To participate in the Challenge, you must: 

• Fill out the Confluent Cost Estimator here.
• Submit a bona fide quote or bill for an Eligible Product, dated within 30 days of submission, showing the product specifications, quantity purchased / consumed, and price.
• Meet with a Confluent advisor and provide any required additional information, in order to determine the Competitor Total Cost.   

Gift Card. If, subject to the eligibility criteria, exclusions, and participation requirements, we cannot meet or beat the Competitor Total Cost on an Eligible Product, you will be offered a USD $500 gift card or opportunity to donate to a designated charity.

Privacy. We will use your business contact details and the information you voluntarily provide to us to schedule and participate in a meeting with you, manage our relationship with you, and provide you with information about Confluent’s products and services. California Notice of Financial Incentive. The following applies only if you reside in California. We provide you with this Notice of Financial Incentive so that you may make an informed decision on whether to participate in the Challenge, which we describe in these Terms. We target enterprise customers and not individual data subjects with the Challenge. We value your time but we do not assign monetary value to the personal information we collect from participants for the purposes of the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020, and the regulations thereunder. You may withdraw from the Challenge at any time by notifying us that you no longer wish to participate.
